Brenden Theatres Terms of Service

1. Acceptance of Terms
By accessing or using the Brenden Theatres website, mobile applications, theatres, or any related content, products, services, or features (collectively, the “Services”), you agree to comply with these Terms of Service and all policies incorporated by reference. If you do not agree, you must not use the Services.

The Services are intended for users aged 18 or older residing in the United States or its territories. By using the Services, you confirm that you meet these requirements and can enter into a binding contract. We do not knowingly collect personal information from children under 13. If we become aware that we have, we will delete it.

-- Marketing: By creating an account, purchasing a ticket, subscribing to a membership, or downloading our app, you may receive promotional emails, text messages, or push notifications.
-- Opt-Out: You may opt out of promotional communications at any time by using unsubscribe links, adjusting app settings, or contacting us. Transactional messages (e.g., ticket confirmations, system updates) will still be sent.
4. App & Digital Services
If you use our mobile app or other digital platforms, you acknowledge that. The app may request permissions (e.g., location, notifications) to provide features such as showtime search, promotions, or mobile ticket scanning. In-app purchases (e.g., memberships, tickets) are billed through your app store account and subject to store terms as well as Brenden’s Membership Terms and Refund Policy. You are responsible for ensuring your device is compatible and updated.

We may update these Terms from time to time. Updates take effect immediately upon posting unless otherwise specified. Continued use of the Services after changes constitutes acceptance.
6. Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts for suspicious activity or violations.
7. Intellectual Property
All trademarks, logos, content, text, images, audio, video, and software on the Services are the property of Brenden Theatres or its licensors. You may not copy, distribute, reverse engineer, or create derivative works without our prior written consent.
8. Prohibited Uses
You agree not to use the Services to:

-- Attempt to gain unauthorized access to systems, networks, or data.
-- Use automated tools (bots, scrapers) to interfere with the Services.
-- Use the Services to purchase tickets for unauthorized commercial resale or to resell or offer tickets for resale at a price exceeding the original ticket price without prior written authorization from Brenden Theatres.
9. User Contributions
Where our Services permit user-generated content (e.g., reviews, comments, uploads):
-- You grant Brenden Theatres a worldwide, perpetual, royalty-free license to use, reproduce, modify, and distribute your contributions.

10. Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, Brenden Theatres disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the maximum extent permitted by law:
-- Brenden Theatres shall not be liable for indirect, incidental, or consequential damages.
-- Our total liability to you for any claim shall not exceed the greater of (i) $100 or (ii) the amount you paid us in the 12 months before the claim.
12. Indemnification
You agree to indemnify and hold harmless Brenden Theatres, its officers, employees, and affiliates from any claims, damages, or expenses arising from:

-- Your violation of these Terms.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Nevada and the Federal Arbitration Act. Any dispute shall be resolved by binding arbitration in Nevada. You waive the right to bring or participate in class, collective, or representative actions.
14. Termination and Enforcement We may suspend or terminate your access to the Services or your Brenden Theatres account at any time, with or without cause. Brenden Theatres reserves the right to cancel tickets that we reasonably determine have been purchased or offered for resale in violation of these Terms. Tickets canceled due to unauthorized resale may be returned to inventory and made available for purchase by the public. Brenden Theatres may also suspend or terminate accounts associated with repeated or egregious violations of these Terms. Upon termination, your right to use the Services ceases immediately.
