01 Reservations and Payment
Full payment is required at the time of booking. A
reservation is not confirmed until payment has been
successfully processed and a booking confirmation
has been issued.
All rental payments are final and nonrefundable,
except where required by applicable law or expressly
provided in these Terms.
Renter is responsible for providing accurate booking
information, including the requested date, time,
location, rental type, and contact information.
02 Cancellations and Changes
Customer-initiated cancellations, missed reservations,
and unused rental time are not eligible for refunds.
Requests to reschedule are subject to availability
and Brenden's approval. Brenden is not obligated
to accommodate rescheduling requests.
Brenden reserves the right to cancel, relocate, or
modify a reservation due to equipment failure,
facility conditions, safety concerns, operational
requirements, or circumstances beyond its
reasonable control.
If Brenden cancels a reservation and cannot provide
a reasonably comparable alternative acceptable to
Renter, Brenden will refund the affected rental
charges.
03 Use of Facilities
Renter and all attendees must comply with Brenden's
theatre policies, posted rules, employee instructions,
and applicable laws.
Rental access is limited to the reserved auditorium,
date, and time. Additional time, facilities, equipment,
or services require prior approval and may incur
additional charges.
Renter is responsible for ensuring that attendees
comply with applicable occupancy limits and
conduct requirements.
Brenden reserves the right to terminate a rental
without refund if Renter or attendees engage in
unsafe, disruptive, unlawful, or prohibited conduct,
subject to applicable law.
04 Damage and Additional Charges
Renter is responsible for physical damage to
Brenden's facilities, furnishings, equipment, or
property caused by Renter or attendees, excluding
ordinary wear and tear.
Renter agrees to reimburse Brenden for reasonable,
documented costs associated with repairing damage,
replacing damaged property, or providing extraordinary
cleaning resulting from the rental.
Additional staffing, cleaning, security, or technical
services requested by Renter or reasonably required
because of Renter's activities may result in
additional charges, subject to applicable law.
05 Personal Property and Equipment
Brenden is not an insurer of Renter, attendees,
or their personal property.
Renter is responsible for personal belongings and
equipment brought onto the premises. Brenden does
not assume custody or responsibility for such
property merely because it is brought into
the theatre.
Any customer-provided equipment must be approved
when required by Brenden and must not interfere
with theatre systems, create safety hazards,
or damage facilities.
06 Content and Licensing
For rentals involving movies, videos, games,
presentations, music, or other customer-provided
content, Renter is responsible for ensuring that
all necessary rights, licenses, and permissions
have been obtained for the intended use.
Rental of an auditorium does not include public
performance rights or other intellectual property
licenses unless expressly provided by Brenden.
Renter may not exhibit unlawful, infringing,
or otherwise prohibited content.
For Now Playing rentals, film exhibition remains
subject to applicable distributor agreements
and Brenden's licensing arrangements.
07 Food and Beverages
All food and beverage sales at Brenden facilities
are exclusively controlled by Brenden.
Outside food, beverages, catering, third-party
vendors, and product giveaways are prohibited
unless Brenden provides prior written authorization.
All alcohol consumption must comply with applicable
laws and Brenden's alcohol service policies.
08 Auditorium Assignments and
Technical Availability
Auditorium assignments, seating configurations,
and available equipment are subject to change
based on operational requirements.
Brenden will make reasonable efforts to provide
a comparable auditorium and the services included
in the confirmed reservation.
Renter acknowledges that customer-provided media,
gaming devices, computers, and other equipment
may not be compatible with theatre systems.
Brenden does not guarantee compatibility with
equipment or content that has not been approved
or tested in advance.
If a material failure of Brenden-provided equipment
prevents delivery of the purchased rental experience,
Brenden will offer an appropriate remedy, which
may include rescheduling or a refund of the
affected rental charges.
09 Responsibility and
Indemnification
Renter is responsible for the conduct of attendees
and for compliance with these Terms.
To the extent permitted by applicable law, Renter
agrees to defend, indemnify, and hold harmless
Brenden Theatre Corporation and its officers,
employees, agents, and affiliates from third-party
claims, losses, damages, and reasonable legal
expenses arising from:
- Renter's or attendees' negligent, reckless,
or intentional misconduct;
- Damage to property caused by Renter
or attendees;
- Renter's violation of applicable laws
or these Terms; or
- Infringement of intellectual property rights
involving content supplied by Renter.
This obligation does not apply to the extent a claim
results from Brenden's own negligence, willful
misconduct, or other conduct for which liability
cannot lawfully be transferred.
10 Limitation of Liability
To the fullest extent permitted by applicable law,
Brenden is not liable for indirect, incidental,
special, or consequential damages arising from
a rental, including lost profits or business
opportunities.
Nothing in these Terms excludes or limits liability
that cannot lawfully be excluded or limited.
11 Commercial Events and
Insurance Requirements
Standard private theatre rentals do not require
Renter to obtain separate liability insurance.
Self-service rentals are intended for private use
unless Brenden expressly authorizes another purpose.
Rentals involving commercial ticket sales, public
advertising, outside vendors, sponsored activities,
or other organized commercial events require
prior written approval.
Brenden reserves the right to require proof of
commercial general liability insurance for rentals
involving commercial events, third-party vendors,
outside contractors, specialized equipment,
physical activities, or other circumstances
presenting elevated risk.
When required, Renter shall provide evidence of
commercial general liability insurance with limits
of not less than $1,000,000 per occurrence and
$2,000,000 general aggregate, naming Brenden
Theatre Corporation as an additional insured.
Coverage shall be primary and noncontributory,
with a waiver of subrogation in favor of Brenden
Theatre Corporation where required by Brenden
and permitted by the applicable policy.
Any required insurance documentation must be
received and approved before access to the
facility is granted.
Brenden may require a separate Facility Use
Agreement, additional fees, or other conditions
for commercial or higher-risk events.
A self-service rental reservation does not authorize
Renter to independently sell admission tickets
or commercially exploit Brenden's facilities.
12Acceptance of Terms
By booking a private theatre rental with Brenden Theatres, Renter acknowledges and agrees to be bound by these Terms & Conditions. Completion of a reservation constitutes acceptance of these Terms without requiring a separate signature or agreement.
The version of these Terms in effect at the time of booking shall govern the reservation.
13 Governing Law and
General Provisions
These Terms are governed by the applicable laws
of the state in which the rented Brenden theatre
is located.
If any provision is determined to be unenforceable,
the remaining provisions will continue in effect
to the extent permitted by law.
These Terms, together with the confirmed reservation
details and any expressly incorporated rental
policies, constitute the agreement between Brenden
and Renter regarding the reservation.
Any exception or modification must be expressly
authorized in writing by Brenden.
