Brenden + and Brenden Basic Membership Program Terms & Conditions

1. Agreement to Terms: By participating in the Brenden + or Brenden Basic Membership Programs, you ("Member") agree to be bound by these Terms and Conditions. Brenden Theatres reserves the right to update, modify, or terminate the Program at any time without notice.

2. Membership Tiers:

Brenden Basic (Free Tier): Members earn points for every visit on movies and snacks at the following rates:

Movies: $1 = 1 point.
Concessions: $1 = 2 points.

Brenden + (Paid Tier): For $9.99/month, members receive additional benefits, including 2 tickets per month, 10% off snacks, and more, in addition to the points system available in Brenden Basic.

3. Monthly Billing and Renewal (Brenden + Only): Brenden + Members authorize Brenden Theatres to charge $9.99/month (or the current rate) until canceled. Brenden Theatres reserves the right to increase the price with prior notice.

4. Cancellation Policy: Cancellations for Brenden + must be initiated through the member’s online profile. No refunds for partial months or unused tickets.

5. No Refunds: No refunds for partial months, unused tickets, or unredeemed points for either membership tier.

6. Unused Tickets (Brenden + Only): Unused tickets do not roll over into subsequent months.

7. Points & Rewards:

Points do not expire and are earned at the following rates:

Brenden Basic and Brenden +: 1 point per $1 spent on tickets, 2 points per $1 spent on concessions.

8. Gift Card Exclusions: Points are not earned on the purchase of gift cards but are awarded when gift cards are redeemed for eligible purchases.

9. Manual Point Adjustments: Members can request manual adjustments for point errors, limited to 2 per calendar month and only for purchases made within the previous 30 days.

10. Changes to the Program: Brenden Theatres reserves the right to change or terminate the Program and associated rewards at any time, with notice provided as required by law.

11. Termination of Membership: Brenden Theatres may terminate or suspend memberships for suspected abuse, fraud, or violations of these terms. Unused points or rewards will be forfeited upon termination.

12. Liability Limitation: Brenden Theatres is not liable for any lost, delayed, or erroneous correspondence or point accumulation.

Brenden Theatres Membership Terms & Conditions

Effective Date: September 12, 2025

These Terms & Conditions (“Terms”) govern the Brenden Basic (free) membership and the Brenden+ (paid) membership programs, including monthly and annual plans (collectively, the “Memberships”). By enrolling in any Membership, you agree to these Terms, as well as our Privacy Policy, Cookie Policy, Refund & Exchange Policy, and Website Terms of Service.

1. Membership Tiers

Brenden Basic (Free)

Brenden Basic members may earn points on qualifying purchases.

Movies: $1 = 1 point

Concessions: $1 = 2 points

Brenden+ (Paid)

Brenden+ members receive all Brenden Basic benefits, plus additional paid benefits, including ticket allotments and discounts. Brenden+ may be offered as a Monthly Plan or an Annual Plan.

Benefits may include:

Monthly or annual ticket allotments (any format)

10% off snacks

Waived booking fees

Member-only perks (screenings, giveaways, discounts)

Points: same earning structure as Brenden Basic

2. Billing, Renewal & Plan Term (Brenden+ only)

Brenden+ Monthly Plan

Brenden+ Monthly is billed in recurring monthly cycles and will auto-renew until canceled.

Billing begins immediately upon enrollment.

Brenden+ Annual Plan

Brenden+ Annual is billed as a one-time annual charge and is valid for one (1) year from the purchase date.

Brenden+ Annual does not renew automatically unless the enrollment page or customer account expressly indicates auto-renewal at the time of purchase.

Payment Method

Payment may be made via credit/debit card or through third-party app stores (Apple/Google), if offered.

If purchased through an app store, billing is handled solely by that store and is subject to its terms.

Price Changes

Brenden may change Membership pricing with at least 30 days’ notice, to the extent required by law.

Continued use after notice constitutes acceptance of the new rate.

3. Cancellation & Termination

Cancellation

Brenden+ Monthly must be canceled through the member’s online account (or through the app store if purchased there).

Emails, phone calls, or in-theatre requests do not cancel a Membership.

Brenden+ Annual expires automatically at the end of the annual term unless renewed.

No Refund Policy

No refunds will be issued for:

Partial membership periods

Unused tickets

Unredeemed points

Any Membership fees (monthly or annual)

Termination / Suspension

Brenden may suspend or terminate a Membership at any time for suspected fraud, abuse, or violation of these Terms. If terminated, unused tickets and points may be forfeited.

4. Tickets, Points & Rewards

Tickets

Monthly Plan: Tickets are issued each membership cycle and expire at the end of that cycle. Tickets do not roll over.

Annual Plan: Annual tickets (or vouchers) are valid through the annual membership term and expire at the end of the term unless otherwise stated at time of issuance.

Tickets have no cash value, are not redeemable for cash, and may have additional restrictions.

Points

Points have no cash value and cannot be redeemed for cash.

Points do not expire unless the program ends or membership is terminated due to abuse/fraud.

Points are not earned on gift card purchases, but points are earned when gift cards are redeemed.

Manual Adjustments

Members may request up to two (2) corrections per calendar month for eligible purchases made within the previous 30 days.

5. Refunds & Exchanges

Membership fees are non-refundable.

6. Program Changes

Brenden may modify, suspend, or terminate any Membership or related benefits, points, ticket rules, reward structure, or fees at any time, with notice as required by law.

If a Membership program ends, tickets and points may expire immediately unless otherwise required by law.

7. Limitation of Liability

To the fullest extent permitted by law:

Brenden Theatres is not liable for any indirect, incidental, special, or consequential damages.

Maximum liability will be the greater of:

(i) $100, or

(ii) the Membership fees paid in the twelve (12) months prior to the claim.

8. Dispute Resolution

These Terms are governed by Nevada law and the Federal Arbitration Act.

Any disputes shall be resolved by binding arbitration in Nevada.

Class actions and representative actions are not permitted.
